
Studio Policy/Terms + Conditions
Welcome to BabyFace Studio! The following handbook and policies are for the safety of you, our staff, and the working artists in the studio. The policies also help to create a positive working atmosphere for our community.
To participate in studio activities, you must sign the studio use waiver and will be held accountable for practicing the policies set forth in this document. You will be asked to sign a waiver for any and all classes regarding what is listed below.
Rules and Regulations
1. Studio Hours and Access:
a.) Only those who are paying for classes or memberships may work in the building. Students and members who are working in the studio during business hours must be cleaned up and ready to leave at the end of their own studio time or hours of operation.
2. Cleaning:
a.) Each customer or student is responsible for cleaning up their area and returning their work or supplies to their designated shelves. Failure to follow the studios clean up policies can result in termination from the studio with no refund.
3. Respectful Environment:
a.) All participants must behave respectfully toward others, instructors, and staff. Disruptive behavior (e.g., harassment, disrespect, unsafe behavior) may result in being asked to leave without a refund in BabyFace LLC’s sole and absolute discretion.
4. Photography and Recording:
a.) Students, customers, or members are allowed to take videos or pictures during their classes or workshops. BabyFace Studio LLC will also be taking photos for promotional use. BabyFace Studio LLC has the sole copyright in perpetuity to any media generated at the Studio and is granted full use of Client’s likeness for promotion or any other purpose.
5. Personal Belongings:
a.) The studio is not responsible for lost or stolen personal items.
6. Glaze and Clay:
a.) In BabyFace Studio, members, customers, and students are only allowed to use the clay and glaze that is sold and used by the studio. If someone wants to use a clay or glaze from outside the studio they must receive permission from Kim, the owner, specifically in advance and in writing.
7. Tools:
a.) Students, members, and customers may bring in their own tools to use for their classes, but BabyFace Studio LLC is not liable for these tools being stolen or broken.
8. Alcohol, Food + Drink Policy:
a. BYOB Events: Certain events, such as "Date Nights" and other special workshops, are designated as BYOB. BabyFace Studio LLC will clearly clarify what classes are and are not BYOB. Participants are welcome to bring their own alcoholic beverages (wine, beer, or other beverages) to enjoy during the event. However, alcoholic beverages are only permitted during designated events and must be consumed responsibly.
b.) BabyFace Studio LLC reserves the right to allow responsible consumption of alcohol. Excessive drinking that leads to disruptive behavior, intoxication, or unsafe actions will not be tolerated. Any participant exhibiting such behavior may be asked to leave the event without a refund.
c.) Substance Use: Illicit Drugs: The use of illicit drugs, recreational drugs, or substances is strictly prohibited on the premises at all times. No vape pens are allowed to be used in the building. No smoking allowed in BabyFace Studio LLC’s back patio area.
d.) Students and members are allowed to bring in their own food to eat. Food and drinks are allowed in certain designated areas. Food and drinks are not allowed at the glazing area.
9. Kiln Safety
a.) No students, members, or customers may touch or unload BabyFace Studio LLC’s kilns or retrieve items out of the kilns.
i.) Bisque/Glaze Work: BabyFace Studio LLC reserves the right to dispose of bisque or fired work that has been in the studio for over 30 days. BabyFace Studio LLC goes through occasional cleaning of the shelves to make space and if BabyFace Studio LLC finds work that has been there for over 30 days BabyFace Studio LLC’s has the right to dispose of it or give it away.
Studio Terms + Conditions
1. Definitions
a.) The Studio: The Studio shall be the property operated by BabyFace Studio LLC by and through its representative Kimberly Canfield.
b.) Member: a Member shall be a category of Client involving a Client who pays a monthly fee each month to use the facility or equipment of the Studio, and include the following sub categories
i. Participant: A Participant shall be any Client of any kind whatsoever
ii. Student: A Student shall be any Client
c.) Guests: A Guest Shall be any person who is not a Client, Guests are not permitted in the Studio
d.) Class: Classes are one-time events provided by The Studio
e.) Workshop: All workshops are typically one-day events unless otherwise noted. If a visiting artist is hosting, the workshop may span one or two days.
2. Indemnity
a. Customer agrees to indemnify and hold harmless BabyFace Studio LLC, and all members, affiliates, associates, employees or representatives of BabyFace Studio LLC for any damages sustained as a result of, in the course of Customer’s business with BabyFace Studio LLC. Customer acknowledges that there are risks inherent with pottery, kilns, glazes, pottery wheels including the risk of serious injury or death, and heretofore assumes any risk associated with these services. Moreover, should Customer’s involvement with BabyFace Studio LLC result in pecuniary or bodily harm in the course of receiving services, Customer accepts complete liability and indemnifies BabyFace Studio LLC of all damages.
i. Dangerous Equipment: In the studio BabyFace Studio LLC has kilns, heavy machinery/equipment, glass, and pottery wheels. If they are not used properly they can lead to injury. In general, the use of this equipment can lead to injury and Client voluntarily assumes that risk.
ii. If a Client or guest mistreats the equipment or supplies the Client shall be liable for damages and expenses.
iii. The Studio supplies students and members with clay and glazes for classes, workshops, date nights, and kids classes. If the Client or other participant brings a clay or glaze into the studio without written prior consent that Client will be held liable for all associated damages.
iv. BabyFace Studio would have the ability to cancel a customer's membership or class with no refund in its absolute and sole discretion.
b.) Client agrees that, should any injury occur on Studio premises, The Client authorizes the studio to seek medical treatment without liability, and any costs associated with said medical treatment shall be the reasonability of the Client.
c.) Retail: Within the studio we BabyFace Studio LLC will be selling retail (including but not limited to handmade pottery, jewelry, cards, clothing, paintings, and photographs. Client agrees that if they or their affiliates damages or breaks any retail they will be held liable for covering the full retail price of that item(s).

4. Payment and Refund Policies
a.) Payment plans
i. For 8-week classes, students have the option to pay a 50% deposit upfront or pay in full at the time of enrollment. The remaining balance must be paid before the start of the 4th class (week 4) in the session. When students sign up, BabyFace Studio LLC will securely store Client’s credit card information. By enrolling, students authorize the studio to debit the remaining balance from their card on the day of the 4th class meeting, unless the student has already taken care of the remaining balance themselves. Students have the option to make the payment themselves through their account. Payment can be made manually through their account or via the receipt sent to their email. If the card on file fails or the student does not provide an alternative payment method or pay the remaining balance in cash, BabyFace Studio LLC reserves the right to suspend Client’s participation in the class until the balance is paid in full. Failure to pay the second half of the balance and continue to attend class will result in termination from the class and the refusal to fire any pending work in the studio’s kilns.
ii. Payment for all other classes, workshops, and memberships must be made in full.
iii. If a student enrolls in an 8-week class and chooses to withdraw at any point during the session, no refund will be provided once the class has started.
b. Gift Cards:
i. BabyFace Studio LLC does not offer any refunds or returns on gift cards or gift certificates. BabyFace Studio LLC gift cards and certificates do not expire.
c. One-time pottery classes:
i. Cancellation 48 hours or more in advance will receive a full refund.
ii. Cancellation within 48 hours will receive no refund.
iii. If Client does not attend there will be no refund.
iv. If Client is to be more than 15 minutes late to the Client must reschedule for another class time but will not receive a credit towards another class or a refund for being late.
d. Workshops:
i. Client cancellation at least 48 hours or more in advance will receive a full refund.
ii. Client cancellation within 48 hours will receive no refund.
iii. If Client does not attend a portion of their multi day workshop there will be no refund.
e. 8 Week Long Classes:
i. Client cancellation 7 or more days before the start of the first class will receive a full refund.
ii. Client cancellation 4-6 days before the start of the class will receive a 50% refund.
iii. Client cancellation 3 days or fewer before the start of the class will receive no refund or credit.
iv. If Client does not attend there will be no refund.
f. Date Night Classes:
i. Client cancellation at least 48 hours or more in advance will receive a full refund.
ii. Client cancellation within 48 hours will receive no refund.
iii. If Client does not attend there will be no refund.
iv. The studio will provide light refreshments and snacks for the class. It is the student’s responsibility to decide whether to consume the provided items. The studio is not liable for any allergic reactions, dietary restrictions, or other health concerns related to the refreshments. Students should exercise their own judgment and caution when choosing to consume the provided food.
g. Kids Classes:
i Client cancellation at least 48 hours or more in advance will receive a full refund.
ii. Client cancellation within 48 hours will receive no refund.
iii. If Client does not attend there will be no refund.
h. Studio Cancellation:
i. In the event of weather, studio facility issues, sickness, etc. BabyFace Studio LLC reserves the right to cancel any class in its sole and absolute discretion. If it is a one-time class (date night, kid’s class, one time throwing class, workshop) BabyFace Studio LLC will issue Client a full refund. If it is an 8 week class BabyFace Studio LLC will extend the option to come in during open studio hours to make up for that class time. BabyFace Studio LLC will notify members or students of that class through email or text if a class is to be cancelled.
i. Assignment:
i. If Client is able to find someone to take their spot in the event they cannot make the class prior to the 48 hour mark before the class commencing BabyFace Studio LLC will issue a full refund. This must be communicated through email with the studio. Once the person who is taking your spot purchases their spot for the class we can proceed forward with issuing a refund. Refund is conditional upon receipt of payment from replacement Client and execution of this document therewith.
5. Notice: All cancellations must be communicated in writing via email to kim@babyfacestudios.com. We do not accept cancellations through text messages, direct messages (DMs), phone calls, or in-person verbal communication.
6. Work Pickup and Storage
a. For one time classes, workshops, kid’s classes, and date nights, the studio will hold onto Client’s piece for pick up for up to 30 days after Client’s piece has been fired in the kiln. After that BabyFace Studio LLC has the right to dispose of the piece or give it away.
b. Because of the nature of pottery there are possibilities of cracks and breaks in the kiln that are out of our control. BabyFace Studio LLC cannot issue a refund or a replacement for Client’s piece.
c. Please allow a minimum of 4 weeks before contacting the studio to ask about pick up.
d. BabyFace Studio LLC will issue a pick-up card at the end of class to indicate the earliest date of pick-up. Students may reach out through email to check the status of their piece to see if it is ready for pick-up
7. Children and Animals
a. Should the Studio provide classes or programs allowing or involving minors, said minors under the age of 16 must be accompanied by an adult not affiliated with BabyFace Studio LLC at all times. Any violation of this provision shall be tantamount to default. BabyFace Studio LLC may terminate service without refund. Client assumes all responsibility to any damage caused by children they bring into the Studio.
b. No Pets Allowed: For the safety, comfort, and well-being of all participants, animals are not allowed inside the studio at any time. This policy applies to both customers and their guests. Service animals are the only exception. Client accepts absolute liability for animals and any damages as a result of animals brought into the studio.
Age and Guest Restrictions:
a. Certain classes we will have age restrictions. For date night classes, participants must be over the age of 21 and must sign a waiver stating they are aware of this at the time of signing up for that class online. BabyFace Studio LLC may allow Clients to bring their own alcoholic beverages to enjoy during the class.
b. For children classes- children under the age of 16 must be accompanied by an adult at all times.
c. Guests- no guests are allowed in the studio to work with members or current students of classes. Anyone working in the studio during a class or open studio must be signed up for a class or membership. Client is prohibited from bringing in guests to work on the wheel to teach them or give them clay. Client may not hold private lessons in BabyFace LLC’s Studio.
9. Studio Policies:
a. Client shall be bound by the Studio’s Rules and Regulations, which are separate from this document and incorporated by reference. These rules and regulations may be subject to change at any time with or without notice in BabyFace Studio LLC’s sole and absolute discretion.
b. Client agrees to inform themselves of these obligations at all times. Any violation of these rules and regulations is tantamount to default and BabyFace Studio LLC may terminate service without refund.
10. Headings:
a. Headings are inserted for the convenience of the parties only and are not to be considered when interpreting this Agreement. Words in the singular mean and include the plural and vice versa. Words in the masculine gender include the feminine gender and vice versa. Words in a neutral gender include the masculine gender and the feminine gender and vice versa.
11. Choice of Law:
a. The terms of this agreement, and all agreements within which these terms are incorporated by reference, shall be construed under, and subject to venue and the jurisdiction of the City of Philadelphia and Pennsylvania law.
12. Succession:
a. This Agreement and the terms and conditions contained in this Agreement apply to and are binding upon the Client's successors, assigns, executors, administrators, beneficiaries, and representatives.
13. Severability:
a. If any term, covenant, condition or provision of this Agreement is held by a court of competent jurisdiction to be invalid, void or unenforceable, it is the parties' intent that such provision be reduced in scope by the court only to the extent deemed necessary by that court to render the provision reasonable and enforceable and the remainder of the provisions of this Agreement will in no way be affected, impaired or invalidated as a result. This document shall not be construed against the drafter and considered an arms-length agreement.
14. Counter Parts: This Agreement may be executed in counterparts.
15. Time: Time is of the essence in this Agreement.
16. Attorney’s Fees and Court Costs:
a. Should BabyFace Studio LLC be drawn in legal proceedings including mediation, arbitration, civil court proceedings, pre-litigation discovery or any other legal matters excluded from this non-exhaustive list, Client will pay BabyFace Studio LLC’s reasonable attorney’s fees and court costs. Client agrees that all disputes will be handled via arbitration, arbitrator shall be chosen in BabyFace Studio LLC’s sole and absolute discretion.
17. Merger/prohibition on Parol Evidence:
a. This Agreement and BabyFace Studio LLC’s rules and regulations are and consist of the entire agreement between the parties, no other documents are incorporated by reference All negotiations and understandings have been included in these Agreements. Statements or representations that may have been made by any party to this Agreement in the negotiation stages of this Agreement may in some way be inconsistent with this final written Agreement. All such statements have no force or effect in respect to this Agreement. Only the written terms of these Agreements will bind the parties.
18. Notice:
a. Any notices or delivery required here will be deemed completed when hand-delivered, delivered by agent, or seven (7) days after being placed in the post, postage prepaid, to the parties at the addresses contained in this Agreement or as the parties may later designate in writing. Email notice is sufficient for contact purposes.
19. Cumulative Rights/Remedies:
a. All of the rights, remedies and benefits provided by this Agreement will be cumulative and will not be exclusive of any other such rights, remedies and benefits allowed by law. Interpretation. This clause shall be construed as being drafted by both parties, rather than construed against one as a drafter. Both parties agree that this agreement is drafted by both parties, in a fair, arms-length negotiation. Client has been advised to seek independent counsel before signing this document.
20. Venue and Mediation:
a. Customer agrees that, should an issue of law arise between the parties, issues of expediency and cost of litigation merit that all parties agree to submit to binding arbitration. Customer agrees that BabyFace Studio LLC will have unilateral authority to select an arbitrator, but that said selection will occur promptly, within six months of receipt of written notice from Customer of intent to pursue legal action. Customers acknowledge that they are advised to seek legal counsel before entering into any agreement and have been given adequate time to seek such advice prior to signing this document.
21. Memberships
a. Monthly Payments- Each month on the day of the first day of enrollment, we will send out invoices to our Clients who are members. Failure to pay on time may result in termination of membership and use of the studio. If BabyFace Studio LLC does not receive payment for that invoice within 3 business days BabyFace Studio LLC shall have the right to suspend access to the studio until it is paid or terminate that membership and future access to the studio. BabyFace Studio LLC shall also have the right to clear off that member's shelf space to make room for another spot.
b. Cancellation- Memberships can be canceled at any time, but written cancellation by Client must be received at notice BabyFace Studio LLC’s notice address at least 7 days before the next billing cycle. No refunds will be issued for partial months. Before the beginning of the next billing cycle, members must also move their work and personal belongings out of the building if they choose to cancel.
c. Change of membership- if a member chooses a different tier option for their membership, this must also be received in writing at BabyFace Studio LLC’s notice address at least 7 days before the next billing cycle.
d. Members are only allowed to access the studio during time slots allocated to them. If BabyFace Studio LLC implements a system allowing memberships to include key card or code access to the studio in the future, members will not be permitted to bring guests or share their key card or code with anyone. Additionally, members may only use their key card or code during designated studio hours. Members may not bring guests with them into the studio. Any violation of this provision shall be tantamount to default. BabyFace Studio LLC may terminate service without refund.
e. Members will be given access to the building during studio hours with a key/card code, or may message BabyFace Studio LLC to request access. This code or key may not be copied or given to any else to use.
f. Members may not bring in their own clay or glaze. All clay must be purchased through the studio. If members want to bring in their own glaze, BabyFace Studio LLC must check it first and approve of it through writing.
g. Membership space:
i. Members will be designated their own space to work. They are responsible for taking care of it and cleaning up after themselves.
h. After the conclusion of an 8 week class, students are expected on the last class day of the session to clear off their shelves completely and take their belongings with them. Anything left behind will be disposed of. Students from that session will have 30 days from the last day of class to come back to come claim their work.
